RULES

Thank you for your interest in the CanUSing Your Way To Fenway Contest (the "Contest") organized by Hitlab Inc. ("Hitlab") and the Boston Red Sox (“Red Sox”). The winner of the contest will perform the national anthem at the Boston Red Sox VS New York Yankees baseball game (the “Event”) on the Fenway Park in Boston (the “Venue”) on September 18th 2016.

PARTICIPATION RULES

Please note the following important information. By entering the Contest each entrant (individual) must agree that:

  1. You will be able to prove at the time of your registration:
    • your citizenship; and
    • that you possess a valid U.S. passport, or in the case of non-citizen, a valid foreign passport, U.S. immigration documents, and other documentation allowing you to legally enter the United States; and
    • that you are or will be at least 13 years old on August 17th, 20161.
  2. In order to participate in the Contest, you will be required to submit a valid email address and fill out and agree to all of the terms and conditions as described on Hitlab's website and Can U Sing mobile app IF YOU FAIL TO COMPLETE ANY FORM, GIVE ANY FALSE INFORMATION, OR FAIL TO REVEAL ANY PERTINENT INFORMATION, YOU MAY BE DISQUALIFIED FROM THE CONTEST PROCESS.

  3. 1Contestants Under 18 Years of Age: If you will be under 18 years of age on the day you register, be advised that the Hitlab service is only available to you with the consent of your legal parent or guardian. If you are a Minor, please review these Rules and Terms and Conditions with your parent or guardian, and have your parent or guardian subscribe for the service. If you are selected to be a Performer, your parent and/or legal guardian MUST accompany you to the Event. In addition, your parent or legal guardian must bring a government-issued photo ID (for example, a driver's license or passport). If you are accompanied by a legal guardian, as opposed to a parent, your legal guardian must bring proof of guardianship (for example, a court order). If your parent or legal guardian is not available to accompany you to the Event, your parent or legal guardian may appoint a guardian to accompany you to the Event. YOUR APPOINTED GUARDIAN MUST BE AT LEAST 21 YEARS OF AGE AND MUST ACCOMPANY YOU TO THE VENUE FOR THE EVENT. In order to appoint a guardian, your parent or legal guardian will have to complete, sign and have notarized the nomination form that will be provided to you by Hitlab.

    THE CONTEST PROCESS

  4. Entries will be accepted through the CanUSing mobile app only from August 17, 2016 until September 14, 2016 (Midnight Eastern Standard Time).
  5. Each entrant will be able to record his/hers performance of the national anthem (“Recording”) with the Can U Sing app and submit it to the contest via the same app. Along with submitting the recording, entrants will have to share their performance via social media by sharing a link with the score and the information on the participation in the contest.
  6. Members of the general public (the Voters) will be invited to visit Hitlab's Contest Page and listen to submitted recordings. Voters will cast their Vote by sharing their favorite recording from the given list.
  7. On September 15th, Hitlab will choose three (3) contest participants with the 3 best ranked performances among all entries submitted only through the CanUSing mobile app.
  8. The winning performances will be chosen based on the following criteria: the singing scores, social shares, recording quality and internal judgement. Thus, though of big importance, the scores will not be solely based on the scores posted in the app.
  9. The three (3) chosen contest participants will be the finalists and will have to fly to Boston to participate in a final audition in front of judges at Fenway Park, for Contestants Under 18 Years of Age the travel expenses will be covered for one legal guardian. The winner of the final audition will then perform the national anthem at Fenway Park in Boston of September 18th.
  10. Upon closing the contest on Wednesday, September 14th, representatives of Hitlab will contact the three (3) chosen contest participants via email and request a confirmation of each participants willing to be part of the final audition along with the participant contact details: Name, Surname, Phone number, Date of Birth and City. A participant will need to reply with the confirmation and contact details within the next 48hours upon receiving the email. In case a participant does not reply within the given timeframe, Hitlab reserves the right to exclude the participant from the final audition and to contact the next best ranked participant for the purpose of participating in the final audition in Boston.
  11. The list of winners will be announced to the public on the contest's website and social media channels.

PRIZES

The winner of the final audition in Boston will perform the American national anthem at Fenway Park in Boston on September 18th 2016, before the baseball game between Boston RedSox and NY Yankees All expenses for the 3 best ranked performers will be paid including airfare, accommodations, local transportation and pocket money.

GENERAL CONDITIONS

By participating to this Contest, you agree that neither you nor any of your immediate family members (spouse, ex-spouse, parents, siblings, children, step-children) or members of your household (whether or not related to you) are current employees, directors, officers, independent contractors, agents, or representatives of Hitlab or the Boston Red Sox, or any other sponsors of the ContestContest, their respective parents, subsidiaries or affiliated companies, or any of their respective licensees, successors or assigns. Hitlab reserves the right to remove from the Contest any person it determines, in its sole discretion, is sufficiently connected with the Contest or any of the entities described in this paragraph such that such persons participation in the Contest could create the appearance of impropriety.

Hitlab reserves the right to disqualify and/or exclude, in its sole and absolute discretion, any individual from the Contest for any reason or for no reason at all, including without limitation, violation of any portion of these rules, or tampering with the entry process or the Contest process. Hitlab also reserves the right to change the rules and terms and conditions at any time.

Hitlab or any person or entity connected with the production, administration or judging of the Contest, or any of their respective parent companies, affiliates, subsidiaries, successors and assigns, and the respective officers, directors, employees, agents, contractors, partners, shareholders, attorneys, representatives and members of each of the foregoing entities are not responsible for and shall not be liable for: i) any failure or inability of any person to submit material, for any reason caused by any technical failure (such as any computer, telephone, cable, network, electronic, or Internet hardware or software malfunctions, failures or other accessibility or availability issues, unauthorized human intervention, or any other error, omission, or technical malfunction that may occur) or human error that may occur in the processing of submitting material for the Contest; ii) any injuries, losses or damages of any kind caused by traveling to or from the Event venues, being present at the Event venues, participating in the Event; iii) any losses or damages of any kind caused by being selected to or disqualified from continuing in the Contest process and the Event; or iv) any losses or damages for any printing, typographical or technological errors in any materials associated with the Contest process.

All federal, state, provincial or local taxes on prizes, if any, are the sole responsibility of the prizewinner.

As a condition of participating in the Contest, the entrant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with the Contest, shall be resolved individually, without resort to any form of class action. Any such dispute arising out of or relating to the Contest will be referred to and determined by private and confidential mediation before a single mediator chosen by the parties and at their joint cost. Should the parties after mediation in good faith fail to reach a settlement, the issue between them shall then be determined by private, confidential and binding arbitration under the rules set forth by the Canadian Commercial Arbitration Centre. Both mediation and arbitration shall be located in Montreal, Quebec, Canada. The Arbitration tribunal shall apply the laws of the province of Quebec, Canada without regard for rules of conflicts of law. In any such dispute, the entrant shall, under no circumstances, be entitled to claim punitive, incidental, or consequential damages or any other damages, including attorneys' fees, other than the entrant's actual out-of-pocket expenses (if any) associated with participating in the Contest, and the entrant hereby waives all rights to have damages multiplied or increased.

The Contest is governed by the laws of Canada and the province of Ontario, If your residence is located outside Canada, this Agreement and your use of the Karaoke App and of the Hitlab Service shall be governed by the laws of the United States and the state of New York. VOID IN PUERTO RICO, RHODE ISLAND, TENNESSEE, AND WHEREVER PROHIBITED BY LAW WITH NO EXCEPTIONS. Red Sox is a registered trademark of Fenway Sports Group and is used under license.

RIGHTS OF OWNERSHIP

By participating to this Contest, you agree to grant the rights to Hitlab to use your submitted material consisting of your Full Name, Photos and Music as part of promotional online or offline material including but not limited to websites, social media posts and shares or activities, banners, images, show cases, case studies, brochures, music files, videos and others. Hitlab has the right to post the material as is or edit, modify and integrate the material in other work whether this work is for non-profit, for profit or for promotional use as part of this Contest or any future work not related to the Contest.
